Terms of Service

Welcome to the Acorn & Ash online shop.

These Terms of Service ("Terms") govern your use of the Acorn & Ash online store, related checkout services, and purchases made through the store. The terms "Acorn & Ash," "we," "us," and "our" refer to Acorn & Ash, LLC, an Oklahoma limited liability company.

Our online store is powered by Shopify, which provides the ecommerce technology that allows us to offer products and process orders.

Please read these Terms before using the store or placing an order. By accessing the store, submitting an order, or otherwise using the services offered through it, you agree to these Terms and our Privacy Policy.

If you do not agree with these Terms, please do not use the store.

1. About Acorn & Ash

Acorn & Ash is a small, independently operated personal-care company based in Claremore, Oklahoma.

We formulate and sell cosmetic personal-care products in limited quantities. Product availability may therefore change as inventory is produced, released, sold, or replenished.

Nothing in these Terms should be interpreted as limiting any rights you may have under applicable consumer-protection law.

2. Eligibility and Customer Information

You must be legally capable of entering into a purchase agreement in your jurisdiction to place an order.

When placing an order, you agree to provide information that is accurate, current, and complete, including your:

  • name;

  • billing information;

  • shipping address;

  • email address; and

  • other information reasonably necessary to process and fulfill your order.

You are responsible for ensuring that shipping and contact information is correct before submitting your order.

If customer-account functionality is offered, you are responsible for protecting your account credentials and for activity performed through your account.

3. Our Products

We make reasonable efforts to describe our products accurately, including their:

  • intended cosmetic use;

  • size;

  • ingredients;

  • directions;

  • warnings;

  • packaging; and

  • appearance.

Because screen displays, lighting, photography, manufacturing tolerances, and natural variation in some raw materials can affect appearance, the product you receive may vary slightly in color or appearance from photographs displayed online.

Minor variation that does not materially affect product identity, safety, quantity, or intended use is not considered a defect.

We may revise, discontinue, limit, or temporarily suspend a product when appropriate because of inventory, formulation, packaging, supply, quality, regulatory, or other legitimate business considerations.

4. Cosmetic Use and Product Information

Acorn & Ash products are cosmetic personal-care products unless expressly stated otherwise.

Information provided through our store, product pages, ingredient pages, labels, educational materials, or related content is intended to explain cosmetic use, formulation purpose, and product characteristics.

It is not intended as medical advice and should not be used as a substitute for evaluation, diagnosis, or treatment by a qualified healthcare professional.

Individual ingredient information does not establish that a finished Acorn & Ash product treats, prevents, or cures any disease or medical condition.

Customers should read and follow the directions, warnings, and intended-use information provided with each product.

If irritation or another unexpected reaction occurs, discontinue use and contact Acorn & Ash through our Product Support process.

5. Conditioning Tattoo Oil

Conditioning Tattoo Oil is intended only for use on closed, intact, fully healed tattooed skin.

It is not intended for:

  • fresh tattoos;

  • open or broken skin;

  • wounds;

  • scabbed or actively peeling tattooed skin; or

  • use as part of tattoo healing or wound care.

Conditioning Tattoo Oil conditions the skin. It does not restore, repair, renew, recolor, or alter tattoo ink.

It contains no sunscreen unless a future product label expressly states otherwise.

6. Orders and Acceptance

Submitting an order is an offer to purchase the products identified in the order.

An order is accepted when payment is successfully processed and we confirm the order.

We reserve the right to decline or cancel an order when reasonably necessary, including because of:

  • insufficient inventory;

  • pricing or listing errors;

  • suspected fraud;

  • payment problems;

  • shipping restrictions;

  • duplicate or unusual orders;

  • suspected unauthorized resale; or

  • other circumstances that prevent us from safely or reasonably fulfilling the transaction.

If we cancel an order after payment has been collected, we will issue an appropriate refund to the original payment method.

Because Acorn & Ash operates with limited production inventory, placing an item in a cart does not guarantee availability until checkout is completed.

7. Inventory and Quantity Limits

Product quantities may be limited.

We may establish reasonable purchase limits when necessary to:

  • protect available inventory;

  • prevent unauthorized resale;

  • support fair customer access; or

  • manage limited production runs.

Products shown as sold out cannot be purchased unless Acorn & Ash expressly offers a preorder or backorder program.

8. Prices, Taxes, and Payment

Prices are shown in U.S. dollars unless otherwise stated.

The price charged is the price displayed and confirmed at checkout at the time the order is placed, subject to correction of obvious errors.

Applicable:

  • sales taxes;

  • shipping charges; and

  • other disclosed charges

will be shown during checkout where applicable.

Acorn & Ash may change prices at any time for future purchases. A later price change does not alter the price of an order that has already been accepted.

Payments are processed through Shopify and authorized payment providers.

Acorn & Ash does not directly request or store complete payment-card numbers through ordinary website forms.

9. Shipping and Delivery

Current shipping methods, charges, processing expectations, and geographic restrictions are described in our Shipping Policy.

Shipping and delivery dates are estimates unless expressly stated otherwise.

Acorn & Ash is a small business and does not control carrier networks, weather events, transportation disruptions, or other circumstances outside our reasonable control.

However, we will not simply dismiss a customer because a carrier problem occurs.

If an order appears lost, arrives damaged, arrives leaking, or experiences another delivery problem, please contact us so we can review the circumstances and work toward an appropriate resolution.

Nothing in this section limits rights that cannot legally be waived under applicable law.

10. Returns and Refunds

Returns, replacements, and refunds are governed by our Return and Refund Policy.

Because Acorn & Ash products are personal-care products, special return limitations may apply once a product has been opened or used.

Those limitations do not prevent customers from contacting us regarding:

  • damaged products;

  • defective packaging;

  • incorrect orders;

  • leakage;

  • fulfillment errors; or

  • unexpected product reactions.

Product-safety concerns are reviewed separately from ordinary change-of-mind returns.

11. Local Pickup or Handoff

Acorn & Ash may occasionally arrange local pickup or handoff by prior agreement.

Unless Acorn & Ash expressly identifies a public retail location, no address associated with the company should be treated as a walk-in retail store or public pickup location.

Customers should not arrive at a business, mailing, manufacturing, or residential address without prior confirmation.

12. Product Availability and Small-Batch Production

Acorn & Ash manufactures and releases products in relatively small quantities.

This means:

  • some products may sell out;

  • replenishment may take time;

  • packaging may evolve between production generations; and

  • future batches may use updated packaging or labeling while maintaining the same product identity where appropriate.

We do not guarantee continuous availability of every product.

Where packaging changes, we will make reasonable efforts to ensure that product photographs and descriptions accurately reflect the item currently being sold.

13. Personal Use and Resale

Products purchased through the consumer store are intended primarily for personal or household use.

Purchase of a product does not automatically authorize the purchaser to:

  • represent themselves as an Acorn & Ash retailer;

  • resell products commercially;

  • alter or relabel Acorn & Ash products;

  • use Acorn & Ash trademarks in commercial promotion; or

  • imply an official wholesale, distributor, or business relationship.

Retailers interested in carrying Acorn & Ash products should contact us separately regarding future wholesale arrangements.

14. Intellectual Property

The Acorn & Ash name, logo, product names, original written content, graphics, photographs, educational materials, website design elements, and other original materials are owned by Acorn & Ash, LLC or used with permission, except where otherwise identified.

You may access and use the store for ordinary personal and non-commercial purposes.

You may not reproduce, republish, distribute, sell, commercially exploit, or create misleading derivative uses of protected Acorn & Ash material without permission.

Nothing in these Terms transfers ownership of Acorn & Ash intellectual property to you.

Third-party names, trademarks, platforms, or materials remain the property of their respective owners.

15. Customer Reviews, Feedback, and Submitted Content

We welcome honest customer feedback.

If you voluntarily submit a product review, testimonial, photograph, suggestion, or other content for publication or marketing use, we will only use that material in accordance with permissions reasonably associated with the submission or separately obtained from you.

Submitting ordinary private customer-support correspondence does not automatically give Acorn & Ash unlimited rights to publish your message, photograph, name, medical information, or personal experience for advertising purposes.

If we wish to use identifiable customer content in marketing beyond the context in which it was submitted, we may request additional permission.

Reviews and testimonials must reflect genuine experiences.

We may decline or remove content that is:

  • unlawful;

  • fraudulent;

  • abusive;

  • defamatory;

  • threatening;

  • spam;

  • unrelated to the product or service being reviewed; or

  • inconsistent with applicable advertising or platform requirements.

We will not intentionally alter a customer's review to create a materially different meaning.

16. Third-Party Services and Links

Our store may use or link to services operated by third parties, including payment processors, shipping carriers, analytics providers, or other service providers.

Their services may be governed by their own terms and privacy practices.

Acorn & Ash is not responsible for unrelated third-party websites or services merely because a link to them appears through our store.

17. Relationship With Shopify

Acorn & Ash is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Acorn & Ash.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Acorn & Ash, including any injury, damage, or loss resulting from purchased products and services.

You hereby expressly release Shopify and its affiliates from claims, damages, and liabilities arising from or related to purchases and transactions made directly with Acorn & Ash, to the extent permitted by applicable law.

18. Privacy

Personal information collected through the store is handled according to our Privacy Policy.

Shopify and other service providers may also process information as necessary to provide ecommerce, payment, fraud-prevention, analytics, or related services.

19. Errors and Corrections

Occasionally, information on the store may contain:

  • typographical errors;

  • outdated information;

  • incorrect pricing;

  • inventory errors;

  • inaccurate shipping information; or

  • other unintended mistakes.

We may correct such errors when discovered.

If an error materially affects an order that has already been placed, we will make reasonable efforts to contact the customer and provide an appropriate resolution, which may include cancellation and refund.

20. Prohibited Uses

You may not use the store or related services to:

  • violate applicable law;

  • commit fraud;

  • interfere with store security or operation;

  • introduce malware or malicious code;

  • attempt unauthorized access to systems or accounts;

  • impersonate another person or entity;

  • misuse another person's personal information;

  • infringe intellectual-property rights;

  • scrape or extract store content in a manner that materially disrupts the service or violates applicable law; or

  • engage in conduct intended to harm Acorn & Ash, Shopify, customers, or other users.

Reasonable use of ordinary search engines, accessibility tools, browser functions, and legitimate automated technologies is not prohibited merely because the technology is automated.

21. Availability of the Store

We work to keep the online store available and functioning properly.

However, access may occasionally be interrupted because of:

  • maintenance;

  • software updates;

  • internet outages;

  • Shopify outages;

  • security issues;

  • third-party service failures; or

  • circumstances outside our reasonable control.

We do not guarantee uninterrupted access to the store at all times.

22. Disclaimer of Warranties

Acorn & Ash does not promise that every customer's subjective experience with a cosmetic product will be identical.

Skin feel, scent perception, application preference, grooming preference, and other subjective experiences may vary.

Except for warranties or protections that cannot legally be excluded, the store and related online services are provided on an "as available" basis.

Nothing in these Terms is intended to disclaim Acorn & Ash's responsibility to provide products that comply with applicable law or to eliminate consumer rights that cannot legally be waived.

23. Limitation of Liability

To the fullest extent permitted by applicable law, Acorn & Ash will not be liable for indirect, incidental, special, punitive, or consequential losses arising solely from use of the online store when such losses were not reasonably foreseeable.

This limitation does not apply where liability cannot lawfully be excluded or limited.

Nothing in these Terms is intended to exclude or limit liability for matters that applicable law does not permit a business to disclaim.

24. Indemnification

To the extent permitted by law, you agree to be responsible for losses or claims arising from your own unlawful use of the store, intentional violation of these Terms, infringement of another person's rights, or fraudulent conduct.

This section is not intended to make an ordinary customer responsible for Acorn & Ash's own negligence, unlawful conduct, product defect, or other responsibility that properly belongs to Acorn & Ash.

25. Termination or Restricted Access

We may restrict or terminate access to the store when reasonably necessary because of:

  • fraud;

  • abuse;

  • unlawful activity;

  • security threats;

  • repeated violations of these Terms; or

  • conduct that materially interferes with operation of the store.

Termination of store access does not affect rights or obligations relating to transactions that occurred before termination.

26. Governing Law

These Terms and purchases made through the Acorn & Ash store are governed by applicable federal law and the laws of the State of Oklahoma, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Any dispute subject to court jurisdiction will be handled in an appropriate state or federal court with jurisdiction over the matter.

Nothing in this section deprives a consumer of rights or remedies that cannot legally be waived.

27. Severability

If any provision of these Terms is found unlawful or unenforceable, that provision will be enforced to the greatest extent permitted by law or severed where necessary.

The remaining provisions will continue in effect.

28. No Waiver

If Acorn & Ash does not immediately enforce a provision of these Terms, that does not mean the provision has been waived.

29. Entire Agreement

These Terms, together with the policies incorporated by reference, form the agreement governing use of the Acorn & Ash online store and purchases made through it.

Applicable policies include our:

  • Privacy Policy;

  • Return and Refund Policy;

  • Shipping Policy; and

  • any product-specific terms or disclosures presented at the time of purchase.

30. Changes to These Terms

We may revise these Terms as our products, services, business operations, or legal obligations change.

The current version will be posted on this page with an updated effective date.

Changes apply prospectively unless applicable law requires otherwise.

Material changes will be communicated when required by law.
